Inmobiliaria FJ Remax, S.A. de C.V. the developer of the real estate project known as “Central Garden,” whose website is https://centralgarden.com.mx/, hereinafter referred to as “Central Garden,” with its registered office at 16661 San Martin Street, Río Tijuana Neighborhood, Third Phase, Zip Code 22226, in Tijuana, Baja California.

Central Garden is responsible for the use, processing, and protection of your personal data in accordance with this privacy notice, for the following purposes:

PURPOSES:

A. Purposes necessary for maintaining the relationship with the data subject for the purpose of purchasing a property in the Central Garden real estate development:

A.1 Prospective clients.

  • Identity verification.
  • Contacting the data subject by any means provided to Central Garden for the purpose of following up on their process.
  • Addressing questions, comments, and inquiries regarding the property in question, payment methods, and information about other real estate projects developed by Honor Desarrollos.
  • Providing the data subject with the necessary documentation within the procedure carried out with Central Garden for their review, understanding, and signature.

 

A.2 Customers.

  • Identity verification.
  • Creation, integration, updating, and maintenance of your single file for the purchase of a property, compliance with legal provisions, 
  • Contacting the Data Subject by any means for which they have provided Central Garden with their contact information in order to manage, process, and follow up on the property purchase process.
  • Providing follow-up services for sales, closing, customer service, and other processes necessary to ensure the Data Subject feels secure and confident with Central Garden.
  • Contacting the Data Subject via any means for which they have provided contact information to Central Garden to clarify and follow up on payments, as well as to process them.
  • To contact the Data Subject by any means for which the Data Subject has provided information to Central Garden to facilitate the submission and follow-up of complaints, suggestions, and comments regarding purchased products.
  • To evaluate and assess, from an accounting, administrative, legal, and commercial perspective, the establishment of a relationship between Central Garden and the Data Subject.
  • To issue invoices and collect payments for the purchase of Central Garden properties.
 

B. Other Purposes:

  • Research, records, statistics, and market analysis.
  • Promotion and marketing of Central Garden products.


Central Garden informs you that you may object to the processing of your personal data for the purposes listed in section B. Such objection must be communicated to Central Garden’s Legal Department by sending an email to juridicoventas@honordesarrollos.com within 5 business days. This objection shall not be grounds for us to deny you the products you request or contract with us.

Security cameras are installed within the Central Garden real estate development, which may capture images and/or video of activities taking place in common areas, such as hallways, elevators, waiting rooms, the pool area, and recreational areas, among others. This is done for the safety of you and the people who visit and work at these facilities.

To achieve the purposes described above, Central Garden will process the following:

PERSONAL INFORMATION:

The following contact and identification information: Name, date of birth, place of birth, nationality, age, gender, occupation, phone number, address, email address, Unique Population Registry Code, Federal Taxpayer Registry number.

FINANCIAL AND ASSET INFORMATION:

If necessary, the following financial and asset information will be collected: bank account information, tax information, proof of income, and financial statements.

SENSITIVE DATA:

In order for Central Garden to conduct the analysis required to obtain a mortgage loan—so that the Data Subject may purchase a property using such a loan—it will be necessary to collect and process personal data considered sensitive, related to current and future health status. This data will be treated with strict confidentiality for the purposes stated above.

DATA TRANSFER:

To fulfill the purposes referred to in Section A, Central Garden may transfer the personal data it holds, both within and outside the country, to legal and administrative professionals involved in fulfilling the purposes of this notice, such as attorneys not affiliated with Central Garden, notaries, trust institutions, their support staff, service providers, or, where applicable, with competent authorities, as well as to comply with the exceptions provided for in Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties.

The consent of the data subjects will not be required when transfers are made to companies within the same Honor Desarrollos group to which Central Garden belongs, when such a transfer is necessary for the acquisition of a property or to keep the single file up to date.

The data subject may revoke consent for the transfer of their personal data by sending an email to juridicoventas@honordesarrollos.com or by submitting a written notice to the Central Garden address corresponding to the relevant real estate development, specifying the restrictions on use they wish to impose.

EXERCISE OF RIGHTS OF ACCESS, CORRECTION, DELETION, AND OBJECTION (ARCO).

All personal data will be processed in accordance with current legislation; consequently, the data subject shall at all times have the right to access the data held by Central Garden, to rectify it if it is incomplete or inaccurate, to request its erasure when its processing is excessive for the purposes for which it was provided, and to object to its processing, by submitting a request to the legal department via email at juridicoventas@honordesarrollos.com, using the request form available at https://centralgarden.com.mx/, or by delivering it in person to Central Garden’s office, Monday through Friday from 9:00 AM to 2:00 PM, containing the following information:

  • Data subject’s name
  • Data subject’s address or email address for communicating the response to the request
  • Documents proving the identity of the data subject or, if applicable, their representative, along with the respective document proving the authority under which they are acting in the request.
  • A clear and precise description of the personal data regarding which you intend to exercise any of the ARCO rights.
  • Date of service, company, and address of the real estate development to which you provided your personal data.
  • Any other information that allows for the identification of the personal data and the processing of the request.

PRIVACY POLICY:

To prevent unauthorized access to personal data and to ensure that the information is used for the purposes set forth in this Privacy Notice, Central Garden has established physical, electronic, and administrative procedures to prevent the misuse or disclosure of personal data, enabling Central Garden to process it appropriately. These procedures are constantly evaluated and reviewed by the Legal Department to control the use and disclosure of data.

You may limit the use or disclosure of your personal data by sending an email to juridicoventas@honordesarrollos.com or by delivering a written notice to the real estate development’s address, specifying the limitation on use you desire.

Please be advised that Central Garden uses cookies, web beacons, and other technologies on its website to monitor your behavior as an internet user, provide you with a better service and user experience while browsing our site, and offer you new products and services based on your preferences.

The data we collect from these tracking technologies includes the following: browsing times, information about the visitor’s IP address/domain name, websites that refer visitors to our site, behavior and time spent on the website, pages visited, tools used, ZIP code, browser type, and operating system, among others.

Most browsers allow you to disable cookies, block the acceptance of cookies, or receive a warning before cookies are stored.

UPDATES TO THE PRIVACY NOTICE:

Central Garden reserves the right to make modifications or updates to this Privacy Notice at any time to comply with new legislative or jurisprudential provisions, internal policies, and/or new requirements for the sale of real estate. This information will be available to you at https://centralgarden.com.mx/ and/or through notices posted at Central Garden’s address.
